Terms of Service
These Terms of Service ("Terms") apply to the "Halal Gourmet Japan" smartphone application and related website (the "Service") provided by Moving Squad, Inc. (the "Company"). The Service includes a search function for information on Muslim-friendly restaurants, a user review function, a map-based search function, a favorites registration function, push notification functionality, an image recognition-based ingredient analysis feature, and a login function.
Article 1 (Application of these Terms)
Customers using the Service (hereinafter referred to as "Users") must agree to these Terms before using the Service. Use of the Service by any User shall be deemed as acceptance of these Terms.
Article 2 (Content and Disclaimer of the Service)
The Service provides features such as restaurant information search, particularly useful for Muslim users, and a simplified ingredient judgment support function to assist users in purchasing food and beverages produced by Japanese manufacturers. The Company makes no guarantees regarding the accuracy or completeness of the information on restaurants or the results produced by the ingredient judgment function.
The ingredient judgment function is powered by a proprietary database and AI-based analysis technology; however, the Company does not guarantee and accepts no responsibility for the accuracy of the judgment results. Users shall make their own decisions regarding eating, drinking, and purchases at their own risk.
Furthermore, the Company does not guarantee the accuracy of map information related to restaurant locations. The map information is provided by OpenStreetMap and is subject to the Terms of Use and Privacy Policy outlined in the Open Database License.https://www.openstreetmap.org/copyright
The Company shall bear no responsibility for any transactions, use of information, or relationships with third parties that occur through the Service.
Article 3 (Membership Registration and Withdrawal)
Some functions of the Service require login or membership registration. Users must enter accurate information when registering, and registration using false information is prohibited. Users shall manage their account credentials (email address, password, etc.) at their own responsibility and shall not allow third parties to use their accounts. The Company shall not be liable for any damages resulting from poor management of account credentials.
The Company may, at its reasonable discretion, deny membership registration or suspend user accounts if a violation of these Terms is suspected.
Users may delete their accounts at any time via "Settings – Delete Account" within the Service. Account information will become invalid immediately upon submission of the deletion request and will be permanently deleted upon the Company's completion of the withdrawal process. However, Users agree in advance that their previously submitted data (including posted content) will not be deleted and that the provisions of Article 5 shall continue to apply to such data even after account deletion.
Article 4 (Intellectual Property Rights)
1. All rights (including but not limited to ownership, intellectual property rights, portrait rights, and publicity rights) to the text, images, software, and other content comprising the Service (excluding user-submitted content) belong to the Company or respective third-party rights holders. Users shall not, without prior permission from the Company, reproduce, copy, publish, transfer, store, sell, distribute, or otherwise use such content beyond the scope of personal use, regardless of format or method.
2. If the Company determines that a User has violated the preceding paragraph, it may, without prior notice, suspend or restrict part or all of the User's access to the Service or take any other necessary measures. The Company shall not be liable for any damages or disadvantages incurred as a result of such actions.
3. If a User obtains profit through a violation of Paragraph 1, the Company or the relevant right holder may claim an amount equivalent to the obtained profit.
Article 5 (Handling of Posted Content, Reviews, and Favorites)
Users must ensure that their posted content, including reviews, images, and comments (collectively, "Posted Data"), does not infringe upon the rights of third parties.
User-registered data such as "favorites" and "location-based search history" shall be appropriately managed and used in accordance with the Privacy Policy.
While the copyright to Posted Data belongs to the User, the User grants the Company a free, unlimited, non-exclusive, and irrevocable worldwide license to use such data (including reproduction, display, modification, and distribution) for the purposes of operating and promoting the Service.
Posted Data may include incorrect, inappropriate, or potentially unsafe information. Users shall bear full responsibility for the accuracy and handling of the data they post within the Service.
Users shall be solely responsible for resolving, at their own expense, any claims or demands arising from their Posted Data, including but not limited to claims for damages related to physical, mental, or property harm. Should the Company incur expenses or be required to pay compensation (including legal fees) due to such claims, the User shall reimburse the Company in full.
If the Company reasonably determines that a User has violated these Terms, it may, without prior notice, delete the relevant Posted Data. If a User has registered multiple accounts, such measures may apply to all associated accounts.
Article 6 (Links to Third-Party Websites)
The Service may include hyperlinks to websites operated by parties other than the Company, including advertisements. These links are provided solely for reference purposes. The Company does not control such third-party websites and assumes no responsibility for their content, privacy practices, or any associated risks.
Users are solely responsible for verifying that any websites or software accessed (whether from this Service or elsewhere) are free from viruses, malware, Trojan horses, or other harmful components. The inclusion of any hyperlink does not imply the Company's endorsement or affiliation with the linked website or its operator.
Third-party websites may request Users to link their profiles with the Service. Whether or not to accept such requests is entirely at the discretion of the User, and any such links may be removed at any time.
Article 7 (Suspension or Modification of the Service)
The Company reserves the right to change, suspend, or discontinue any aspect of the Service at its own discretion. In cases of disaster, accident, or emergency, the Service may also be temporarily suspended. The Company shall not be liable for any damages or losses incurred by Users or third parties due to any changes, suspensions, or discontinuation of the Service, whether or not prior notice is provided.
Article 8 (Privacy and Handling of Personal Information)
The Company shall manage and use Users' personal information in accordance with the Service's Privacy Policy.
When using the Service, the Company may collect non-personally identifiable data such as location information, interaction patterns (e.g., screen gestures such as taps or scrolls), cookies, web beacons, device identifiers, and device details (e.g., type, version, model, OS). This information is used solely to analyze access trends and improve the Service and shall not be used for any other purpose.
The Company may outsource the handling of personal information, in whole or in part, to third parties as necessary, provided that appropriate protective measures are implemented.
Article 9 (Prohibited Acts)
Users shall not engage in any of the following acts:
- 1. Acts that violate laws or regulations, or that constitute criminal activity
- 2. Fraudulent or threatening acts against the Company, other Users, or third parties
- 3. Acts that violate public order and morals
- 4. Infringement of intellectual property rights (including copyrights, design rights, patent rights, utility model rights, trademarks, and know-how) of other Users or third parties
- 5. Infringement of portrait rights, privacy rights, honor, credibility, or any other rights or interests of others
- 6. Impersonation of another individual or entity
- 7. Engagement in or promotion of antisocial activities, or any related acts
- 8. Registration or submission of false information
- 9. Pre-election or election campaigning, or any similar acts, including violations of the Public Offices Election Act
- 10. Acts deemed harmful to minors
- 11. Unauthorized reproduction or redistribution of any information, including emails or content from the Service
- 12. Acts that place an excessive load on the Service's network or systems
- 13. Acts that interfere or attempt to interfere with the operation of the Service
- 14. Unauthorized access or attempts to gain unauthorized access to the Company's systems
- 15. Any other acts that the Company reasonably deems inappropriate
Article 10 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any and all disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
